NFL Pushes Supreme Court to Intervene in Prediction Market Battle as Kalshi and Polymarket Face Regulatory Showdown
The NFL has entered one of America's most consequential gambling disputes, urging the US Supreme…
Prediction markets increasingly speak the language of Wall Street: contracts, hedging, liquidity, risk management. Then NFL Sunday arrives, and everyone starts trading football.
That contradiction has become difficult to ignore. The opening weekend of the 2026 NFL season pushed prediction-market activity to a historic high, with $5.83 billion in trading volume. Kalshi accounted for roughly $4.89 billion, according to Aldrin Research data reported by Barron’s.
At almost exactly the same moment, Kalshi is making another pitch: prediction markets as useful financial infrastructure for businesses.
Both stories can be true. But together they reveal something fascinating about what prediction markets are becoming.
Kalshi is not positioning itself as another conventional sports betting operator. Its users trade regulated event contracts whose prices represent probabilities, giving the experience the vocabulary and visual identity of financial markets.
The consumer behaviour underneath that interface can look strikingly familiar.
Around 80% of Kalshi’s trading volume since July 2024 has involved sports, Axios reported while covering the company’s new partnership with the U.S. Hispanic Chamber of Commerce. That partnership is intended to educate small businesses about using prediction markets for risk management.
It creates an extraordinary split-screen image: entrepreneurs learning how event contracts might protect revenue from bad weather while millions of dollars move through markets on NFL outcomes.
Sports is not a quirky side category. It is currently the engine.
There is a legitimate financial idea underneath the branding.
Kalshi has been experimenting with tools that could allow smaller companies to hedge risks traditionally difficult or expensive to insure. Reuters recently reported examples involving regulatory uncertainty, agricultural businesses and promotional campaigns.
The company has also expanded commodities markets and partnered with investment firm ARK Invest around prediction-market data and risk management.
That is considerably more ambitious than the familiar world of casino bonuses and conventional gambling promotions.
Yet consumer adoption has apparently found a much simpler gateway: people really, really like having money riding on sport.
Technology platforms rarely become enormous because consumers immediately embrace their most intellectually ambitious use case.
Crypto promised decentralised finance, but speculation drove much of its cultural explosion. The same tension is visible around crypto casinos, where blockchain infrastructure became compelling to ordinary users partly because it made an already familiar activity feel faster and more internet-native.
Prediction markets may be experiencing their equivalent moment.
“Event contracts” transform a familiar sports wager into something that resembles a trade. Instead of betting odds, users see prices. Instead of placing bets, they buy positions.
Even the ecosystem is becoming less distinct from traditional sportsbooks. Barron’s reported that FanDuel has acted as a market maker on Kalshi, including around combo-style trades.
The supposedly separate worlds are already overlapping behind the interface.
This distinction matters because sports gambling in America has historically been regulated state by state, while Kalshi operates as a federally regulated derivatives exchange.
That has produced growing conflict over whether sports event contracts are meaningfully different from sports bets. The debate becomes harder to dismiss as semantics when NFL weekends generate billions in prediction-market volume.
For the wider gambling industry — including operators competing for attention with free spins and casino promotions — the rise of prediction markets represents a genuinely disruptive new category.
Kalshi’s long-term vision could still be enormous: businesses hedging weather, investors pricing geopolitical events and companies managing unusual risks through markets that previously did not exist.
But the numbers reveal what is paying for the cultural expansion right now.
It is sport.
Prediction markets may eventually become an everyday layer of financial infrastructure. Their strange origin story, however, could be that America first learned to “trade the future” because it wanted another way to have money on Sunday football.
